In these terms and conditions shall apply:

  1. Supplier: Webshop Oh My Lash! the legal entity that offers products and/or services both in its webshop and remotely from the webshop offers to buyers
  2. Buyer: the natural or legal person who deals with Oh My Lash! enters into a (distance) agreement or the natural person who does not act in the exercise of a profession or business who enters into a (distance) agreement with Oh My Lash! concerns

Article 3. Relevance

These general terms and conditions apply to every offer from Oh My Lash! and to any (remotely) concluded agreement between Oh My Lash! and Copper.

  1. In addition to these general terms and conditions, additional terms and conditions may apply to certain services and/or products. If there are any differences between the additional terms and conditions and these general terms and conditions, the provisions of the additional terms and conditions will in principle apply above the general terms and conditions, unless Oh My Lash! is decided.
  2. One or more provisions in these general terms and conditions may only be deviated from if this has been expressly agreed in writing. In that case, the other provisions of these conditions remain in full force.
  3. General terms and conditions used by the Buyer do not apply unless expressly agreed to in writing by Oh My Lash!  
  4. Unless otherwise agreed in writing, the general or specific terms and conditions of third parties will not be accepted by Oh My Lash! recognized.
  5. The text of these general terms and conditions will be written by Oh My Lash! be made available to the Buyer electronically in such a way that this Buyer can be easily stored on a durable data carrier.
  6. Before the (distance) agreement is concluded, the text of these general terms and conditions will be made available to the Buyer. Article 4. The Offer and conclusion of agreements

  1. By using the Oh My Lash! webshop! and/or placing an order, the Buyer accepts these general terms and conditions as well as all other rights and obligations as stated in the webshop and applicable in the webshop.
  2. Oh My Lash! is authorized to use third parties in the execution of an agreement with the Buyer.
  3. The offer from Oh My Lash! is without obligation unless a term for acceptance is stated in the offer.
  4. Offers are valid while stocks last.
  5. If an offer is of limited duration or subject to conditions, this will be explicitly stated in the offer.
  6. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a proper assessment of the offer by the Buyer. Like Oh My Lash! uses images, these are a true representation of the products and/or services offered. Obvious mistakes or errors in the offer bind Oh My Lash! not.
  7. Each offer contains such information that it is clear to the Buyer what the rights and obligations are associated with acceptance of the offer.
  8. An agreement is concluded when the Potential Buyer has expressly supplied or entered data by telephone or in writing on the appropriate input screen of the website and the relevant data has been provided by Oh My Lash! received by telephone or via order form, post or e-mail; - Potential Buyer has during his visit to the Oh My Lash! expressly stated that he wishes to purchase or receive a specific product and/or service; - Potential Buyer has expressly stated by telephone that he wishes to receive a specific product and/or service.
  9. The agreement is concluded, subject to the provisions of the previous paragraph of this article, at the time of acceptance by the Buyer of the offer and compliance with the conditions set therein.
  10. If the agreement is concluded electronically, Oh My Lash! appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment. If Buyer pays electronically, Oh My Lash! to observe appropriate safety measures.
  11. Article 5. Prices

  1. All prices are expressed in euros, in accordance with the legal regulations in this regard, and are exclusive of 21% VAT and other costs such as levies and shipping costs, unless otherwise stated by Oh My Lash! indicated.

  4. If prices for the products and services offered increase in the period between the order and its execution, the Buyer can cancel the order or terminate the agreement within ten (10) days after notification of the price increase by Oh My Lash!

Article 6. Payment

  1. Orders via the webshop can be paid in the following ways: cash (only upon collection), prepayment / bank transfer, ideal, PayPal.
  2. Oh My Lash! may expand payment options in the future. Other payment options will be announced via the website.
  3. Oh My Lash! may require advance payment for some products and services. If advance payment has been stipulated, the Buyer cannot assert any rights regarding the execution of the relevant order or service(s) before the agreed advance payment has been made.
  4. The buyer has the obligation to report any inaccuracies in the payment details provided or stated to Oh My Lash! immediately. to report.
  5. In the event of non-payment or late payment by the Buyer, the Buyer owes interest on the outstanding amount, calculated from the day on which payment should have been made until the day of full payment, whereby an commenced month is counted as a full month.
  6. The Buyer will also be charged for all (extra)judicial costs of whatever nature incurred by Oh My Lash! , as a result of the Buyer's failure to fulfill its (payment) obligations.
  7. In the event of late payment, Oh My Lash! is entitled to terminate the agreement with immediate effect or to suspend (further) delivery until the moment at which the Buyer has fully fulfilled its payment obligations, including the payment of interest and costs due.

Article 7. Sales area

  1. Orders can be delivered worldwide.
  2. Agreements can only be concluded in Dutch/English.

Article 8. Delivery and delivery time

  1. Orders are delivered as quickly as possible. In principle, Oh My Lash! We aim to ship orders placed before 15.00:30 PM on a working day that same day. The final delivery period is 30 days after receipt of the order, with the exception of advance payments, where the final delivery period is XNUMX days after receipt of payment.

  4. If a product that is temporarily out of stock is ordered by the Buyer, it will be indicated when the product is available again and will be resent.
  5. Oh My Lash! strives to report delays to the Buyer by telephone or email within one working day.
  6. Deliveries take place at the address specified by the Buyer during the conclusion of the agreement.
  7. As soon as the products to be delivered have been delivered to the specified delivery address, the risk as regards these products passes to the Buyer.
  8. Different conditions may apply for deliveries abroad.
  9. If delivery is made in parts, Oh My Lash! the right to regard each delivery as a separate transaction.
  10. If you receive items that you did not order, please contact Oh My Lash! within 48 hours.

Article 9. Inspection period / right of withdrawal

  1. The customer has the right to return (part of) the delivered goods within a period of 7 working days. This period starts when the ordered goods have been delivered. Liquids, lotions and glues cannot be returned.
  2. If, after this period, the customer does not return the delivered goods to Oh My Lash! has returned, the purchase is a fact. Before returning, the customer is obliged to notify Oh My Lash! in writing within 7 working days after delivery. . The customer must prove that the delivered goods have been returned on time, for example by means of proof of postal delivery.
  3. Returns of the goods must be made in the original packaging (including accessories and associated documentation) and in new condition. If the goods have been used, encumbered or damaged in any way by the customer, the right to termination within the meaning of this paragraph lapses. Oh My Lash! reserves the right to charge administration costs for returns.
  4. Subject to the provisions of the previous sentence, Oh My Lash! ensure that the full purchase amount, excluding the calculated shipping and administration costs, is refunded to the customer within 30 days after receipt of the return shipment. Returning the delivered goods is entirely at the expense and risk of the customer.
  5. The right of withdrawal does not apply to: services the performance of which, with the consent of the Buyer, has started before a period of seven working days; goods or services whose price is subject to fluctuations in the financial market over which the supplier has no influence, goods that are manufactured according to consumer specifications, for example custom-made, or that have a clearly personal character, for goods or services provided by them nature cannot be returned, for example due to hygiene or that can spoil or age quickly. 
  6. If the returned product has not been received in accordance with the conditions, the purchase amount will not be refunded. The product remains the property of the Buyer, who is obliged to collect its property within two weeks. The product can also be delivered upon request, with delivery costs borne by the Buyer.


Article 10. Defects and Complaint Period

  1. The Buyer is obliged to carefully inspect the products immediately upon receipt.
  2. Complaints from the Buyer relating to defects in the product or the delivery, which are externally observable, must be submitted by the Buyer to Oh within 7 days after delivery (or within 7 days after the invoice date if the products could not be delivered to the Buyer). My Lash! be notified.
  3. Buyer, who is not a consumer Buyer, is not entitled to return products for which there is no substantiated complaint. If this is done without stating valid reasons, all costs associated with return will be borne by the Buyer. Article 11. Retention of title

  1. Ownership of products, notwithstanding actual delivery, will only be transferred to the Buyer after he has fulfilled all obligations under any agreement with Oh My Lash! has been paid in full, including reimbursement of interest and costs, including previous or later deliveries and any work performed or to be performed with regard to the products.
  2. The buyer may not tax, sell, resell, alienate or otherwise encumber the products before ownership has been transferred.

Article 12. Warranty and liability

  1. We sell B2B: this means that our terms and conditions deviate from consumer law. We therefore provide a warranty on our electronic devices for 3 months from the date of receipt of your electrical product. Our lamps have a one-year warranty after receipt of the lamp.
  2. Oh My Lash! is never obliged to pay any compensation to the Buyer or others, unless there is intent or gross negligence on its part.
  3. Oh My Lash! accepts no liability for consequential or business damage, indirect damage and loss of profit or turnover.
  4. If Oh My Lash! is obliged to compensate any damage for whatever reason, then that compensation will never exceed an amount equal to the invoice value with regard to the product or service that caused the damage.
  5. Without prejudice to the provisions of this article, there can be no warranty in the following cases: if the wear and tear can be considered normal, if changes have been made in or to the product, including repairs that have not been made with the permission of Oh My Lash ! or the manufacturer, if the original invoice cannot be submitted, has been changed or made illegible, if defects are the result of inappropriate use or improper use, if damage has been caused by intent, gross negligence or negligent maintenance.
  6. If costs are involved in repairing a defect, the Buyer will be informed of this. If the Buyer does not expressly agree in writing with the cost estimate, it can have its property returned upon payment of the research costs. If the Buyer has not paid these research costs (6) months after submitting the cost estimate, ownership of the product will lapse to Oh My Lash!.

Article 13. Force majeure

  1. In the event of force majeure, Oh My Lash! is not obliged to fulfill its obligations towards the buyer. Oh My Lash! is entitled to suspend its obligations for the duration of the force majeure.
  2. Force majeure means any circumstance beyond its control that prevents the fulfillment of its obligations towards the Buyer in whole or in part. These circumstances include strikes, fire, business disruptions, energy disruptions, disruptions in a (telecommunications) network or connection or communication systems used and/or the unavailability of the internet site at any time, non-delivery or late delivery from suppliers or other third parties engaged and the lack of any permit to be obtained from the government.

Item 14. Persoonsgegevens

  1. Oh My Lash! will only process the Buyer's data in accordance with its privacy policy.
  2. Oh My Lash! takes into account the applicable Dutch laws and regulations.

Article 15. Disputes

  1. On similarities between Oh My Lash! and Buyer to which these general terms and conditions apply, exclusively Dutch law applies.
  2. The parties will first make every effort to settle a dispute by mutual agreement.
  3. Disputes arising from an agreement between Oh My Lash! and Buyer, which cannot be resolved by mutual agreement, the competent court within the district of The Hague will take cognizance, unless Oh My Lash! prefers to submit the dispute to the competent court of the Buyer's place of residence, with the exception of those disputes that fall within the jurisdiction of the subdistrict court.

Article 16. Miscellaneous provisions

Oh My Lash! strives to answer emails sent to info@oh-my-lash.nl within 24 hours.


These provisions form an integral part of the agreement between Oh My Lash! and the student as shown on the confirmation form.

General definitions

The Oh My Lash training institute in Zwolle

  1. The student: the person who, after signing the online registration form or by email, has registered for one of the Oh My Lash! organized training or workshops.
  2. The website: information about the training/workshop of Oh My Lash! which contains all information that is important for the relevant training and workshops.
  3. Distance agreement: an agreement concluded in such a way that exclusive use is made of one or more techniques for distance communication, such as electronic communication.

The training/workshop

1. Oh My Lash! provides the training/workshop as stated on the website.


1. The similarity between Oh My Lash! and the student is entered into in writing. The agreement comes into effect upon receipt of the online registration form on the website or registration by email. The student will receive a confirmation of registration from Oh My Lash!. The student must notify Oh My Lash! in writing of any change in personal information. to report.

Costs of the training/workshop

The following costs are associated with the training:

  1. Tuition: Oh My Lash! determines the amount of the tuition fee and states this on the website.
  2. Teaching aids and materials: Oh My Lash! determines the costs for the learning materials and work materials and mentions them on the website.

Payment of tuition fees

  1. Oh My Lash! determines the terms within which the tuition fee must be paid.
  2. Payment of the tuition fee or an installment thereof must always be made in advance. When paying in installments, the first installment must be paid upon registration.
  3. Oh My Lash! may exclude students who do not meet the agreed financial obligations from further education, in which case, without exception, the tuition fees owed in full are immediately due and payable.

The cancellation of a training/workshop

If the course is canceled by the student, the following cancellation policy applies:

  1. Cancellation must be made in writing to Oh My Lash!
  2. If you cancel up to 2 weeks before the start of the course/training, registration will be canceled free of charge.
  3. If you cancel 2 weeks to 1 week before the start of the course/training, 50% of the total tuition fee will be charged.
  4. If you cancel less than 1 week before the start of the course/training, the full tuition fee must be paid.
  5. If you are unable or no longer able to participate due to illness, please inform us in writing (with a doctor's note). In that case, we will check when you can catch up on the lessons at the next training. However, the payment relief will remain in full force.
  6. Confirmation of the cancellation will be made in writing by the training institute.


  1. Missing lessons does not entitle you to a partial or full refund of the tuition fee

Collection of tuition fees

  1. Regardless of the above, if the student fails to pay the tuition fees due, collection measures will be taken. The amount still to be claimed will be increased by the statutory interest and collection or legal costs.


  1. Oh My Lash! determines which materials and textbooks are used during the training and which materials are made available during the training. The contents of the starter kits are shown on the Oh My Lash website.


  1. Oh My Lash is not responsible for loss, damage or theft of objects belonging to students.
  2. All damage caused by the student, whether deliberately or negligently, will be repaired at the student's expense.
  3. The student is liable for damage to clothing and other property of third parties.
  4. By registering (online) for a training course at Oh My Lash, you indicate that you agree to the aforementioned conditions and general terms and conditions stated on www.oh-my-lash.nl
  5. (Ex-) Oh My Lash students who treat customers have their own responsibility towards their customers. This means that Oh My Lash is never liable for any damage that a customer suffers as a result of treatment from a (former) student.

Lesson times Privacy legislation

  1. Oh My Lash! is entitled to change the training day or lesson time at least 14 days before the start of the training in the event of insufficient registrations or otherwise. If the student cannot agree to this change, the student can make this known in writing within 14 days and the agreement will be terminated without costs for the student. A deposit made will be refunded by Oh My Lash! be refunded within 7 days.


  1. The participant acquires ownership of the course materials after full payment.
  2. The material within the organization of Oh My Lash! may not be reproduced and/or made public by the participant and third parties (employer or otherwise) by means of printing, photocopying, microfilm or in any other way without prior written permission from Oh My Lash!


  1. If the result is satisfactory, the participant will receive a Certificate after completing the training. You will receive this certificate at the end of the training day.
  2. If the results are insufficient, the participant can still take a free test after a period of intensive training (under our remote guidance). It will then be assessed whether the participant is eligible for a certificate.
  3. To certificates from Oh My Lash! no rights can be derived

Complaints procedure

  1. Any complaints can be reported to Oh My Lash via the procedure below, after which they will be processed.
  2. Complaints must always be submitted in writing and addressed to Oh My Lash, Attn. Klunder Baileystraat 13, 8013 RV Zwolle.
  3. Any complaints will be treated by an independent person and as confidential.
  4. If possible, complaints will be handled within 4 weeks. You will receive the outcome of your complaint in writing.
  5. If your complaint cannot be handled within 6 weeks, you will receive a letter from Oh My Lash within 2 weeks confirming your complaint, the reason for the postponement and an indication of the period in which your complaint will be handled.
  6. Oh My Lash will keep all relevant information regarding complaints in its complaints file for a period of 3 years.
  7. Oh My Lash is affiliated with ANBOS under membership number 25300. If your complaint has not been resolved satisfactorily, you can contact ANBOS. Your complaint will be handled in collaboration with 'The Disputes Committee', Bordewijklaan 46, 2591 XR in The Hague. 16.8. The decision of the complaints committee is binding for Oh My Lash and any consequences will be handled quickly by Oh My Lash.

Privacy law

  1. Privacy legislation Personal data is treated strictly confidentially by Oh My Lash and in accordance with the applicable privacy legislation.
  2. When registering, Oh My Lash is given permission to automatically process the personal data obtained from the registration. These personal data are only used for our own activities for administrative and commercial purposes.

Denial of access

  1. Oh My Lash may deny access to training in the event of non-performance. This includes, among other things, failure to pay the course fee or payment on time, but also failure to adhere to order and safety regulations to which the student undertakes according to the general terms and conditions.
